Official Contest Rules

Last updated August 23, 2026

PLEASE READ CAREFULLY. THESE RULES CONTAIN A BINDING ARBITRATION PROVISION, A CLASS ACTION WAIVER, A JURY TRIAL WAIVER, AND A LIMITATION OF LIABILITY THAT AFFECT YOUR LEGAL RIGHTS. SEE SECTIONS 17–19.

NO PURCHASE NECESSARY. NO ENTRY FEE. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. Sponsor and agreement

The Kulture Test (the "Contest") is produced and sponsored by Tom Swoope Events / Premium Life Enterprises LLC ("Sponsor"). Contact: booking@tomswoopeevents.com. By registering for, entering, attending, or participating in the Contest in any capacity, you accept and agree to be bound by these Official Rules and by all decisions of Sponsor, which are final and binding in all matters relating to the Contest. If you do not agree, do not register and do not attend. These Rules constitute the entire agreement between you and Sponsor regarding the Contest and supersede any prior or contemporaneous statement, advertisement, or representation, whether oral or written.

2. Eligibility

Open to legal residents of the fifty United States and the District of Columbia who are 21 years of age or older at the time of entry. Valid government-issued photo ID is required at check-in and again to claim any prize. No exceptions will be made. Employees, officers, contractors, agents, and immediate family members or household members of Sponsor, the host venue, and any prize provider are not eligible to win. They may attend. Void where prohibited or restricted by law. Sponsor may refuse entry to any person for any lawful reason.

3. This is a contest of skill

The Contest is determined by skill — supplying correct answers faster than other contestants. It is not a lottery, raffle, sweepstakes, or game of chance. There is no entry fee. No purchase or payment of any kind is required to enter, participate, or win, and no purchase improves any contestant's chances.

4. How to enter

Register in advance through Sponsor's official registration page or by texting the keyword shown in event promotion. Registration requires a name, email address, and mobile number. Limit one entry per person per event. Duplicate, automated, incomplete, or fraudulent registrations are void and may be removed at Sponsor's sole discretion. Attempting to register through multiple identities, email addresses, or phone numbers is grounds for disqualification from this and all future events. Contestant spots are limited and filled in the order registrations are received. When capacity is reached, further registrants are placed on a waitlist and may be promoted if a spot opens. Placement on the waitlist does not guarantee entry. Do not attend unless Sponsor confirms a spot. Registration is personal and non-transferable. It confers no property right and no guarantee of participation.

5. Venue, arrival, and forfeiture

The venue address is released by text message to registered contestants, typically on the day of the event. Sponsor is not responsible for any message that fails to deliver for any reason, including carrier failure, network outage, blocked or filtered numbers, incorrect or changed numbers, full inboxes, device failure, or user error. Contestants must arrive and complete check-in by the posted deadline. A registered contestant who has not checked in by that deadline forfeits their spot without recourse, and the spot may be reassigned. Registration does not guarantee participation. Sponsor is not responsible for a contestant's travel, transportation, parking, lodging, childcare, or any other cost or arrangement associated with attending, under any circumstances, including if an event is postponed, relocated, shortened, or cancelled.

6. Contest format

The standard format is five rounds, structured approximately as follows for a fifty-contestant field. Round 1: contestants are divided into five heats of approximately ten; within each heat the first four contestants to answer two questions correctly advance; approximately twenty advance. Round 2: two heats of approximately ten; the first five in each heat to answer two questions correctly advance; approximately ten advance. Round 3: two heats of approximately five; the first three in each heat to answer two questions correctly advance; approximately six advance. Round 4: a single heat; the first three contestants to answer three questions correctly advance. Round 5 — the Final: the remaining finalists compete head to head; the first to answer four questions correctly is the winner. Questions cover Hip Hop, R&B, and urban popular culture. It is first to answer correctly, not most correct. Answers must be given aloud after the contestant is recognized by the host. Sponsor reserves the absolute right to modify the number of rounds, heat sizes, advancement thresholds, question categories, timing, and any other aspect of gameplay, before or during an event, to accommodate the number of contestants who check in, venue constraints, time available, technical issues, or any other reason. Material changes affecting a round are announced to contestants before that round begins. No contestant acquires any right to a particular format.

7. Judging and decisions

The host and any judges designated by Sponsor determine, in their sole and absolute discretion, whether an answer is correct, who answered first, and all other questions of gameplay. All such determinations are final, binding, and not subject to review, challenge, appeal, or reconsideration by any contestant or any third party. Where a call is disputed, the host may re-ask, substitute a question, run a tiebreaker, or resolve it by any method they choose. Sponsor's interpretation of these Rules is likewise final and binding.

8. Prizes

The grand prize for each event is announced in that event's promotion. The standard grand prize is $500 USD cash plus a vacation getaway certificate for a stated destination. Cash prizes may also be awarded at intermediate rounds in amounts announced during the event. Sponsor reserves the right to substitute any prize with one of equal or greater value at its sole discretion, for any reason, including unavailability. All prize details not expressly stated are at Sponsor's discretion. Vacation certificate. The certificate is issued by a third-party travel fulfillment company and is subject entirely to that company's terms, blackout dates, booking windows, availability, and conditions. It covers accommodations only. It does not include airfare, ground transportation, meals, resort fees, taxes, gratuities, or incidental charges unless expressly stated in writing. The winner is solely responsible for booking within the certificate's stated timeframe and for every cost not covered. The certificate is non-transferable, has no cash value, and cannot be exchanged for cash or any other prize. Failure to book within the stated period results in forfeiture with no substitute. Sponsor makes no warranty of any kind, express or implied, regarding any prize, including any warranty of merchantability or fitness for a particular purpose, and disclaims all responsibility for the acts or omissions of any third-party prize provider. Prizes are awarded "as is." Sponsor has no obligation to award any prize if no contestant satisfies the winning condition, if an event does not take place, or if insufficient contestants participate.

9. Prize claim, forfeiture, and taxes

To claim a prize a winner must: be present at the event's conclusion, present valid government-issued photo ID, sign Sponsor's prize acknowledgment and release, and, where required, deliver a completed IRS Form W-9. A prize is forfeited, with no substitute or compensation, if the winner fails to satisfy any eligibility requirement; cannot produce valid ID; declines to sign the required releases; declines to provide a W-9 when required; is disqualified under these Rules; cannot be contacted within a reasonable period; or fails to claim the prize within thirty (30) days. Sponsor may award a forfeited prize to another contestant or not at all, at its discretion. Winners are solely responsible for all federal, state, and local taxes on prizes. Where the aggregate value of prizes to an individual meets or exceeds the applicable IRS reporting threshold in a calendar year, Sponsor will issue IRS Form 1099-MISC as required by law. Sponsor does not provide tax advice; consult your own advisor.

10. Recording, likeness, and ownership of content

This event is recorded in its entirety. Video, audio, and photography are captured throughout and used for promotional, commercial, editorial, advertising, broadcast, streaming, and distribution purposes in any medium. By registering and by attending, you grant Sponsor and its successors, licensees, and assigns an irrevocable, perpetual, worldwide, exclusive, fully paid-up, royalty-free, sublicensable, and transferable right and license to record, reproduce, distribute, publicly perform and display, exhibit, broadcast, stream, edit, alter, combine with other material, and otherwise exploit your name, voice, likeness, image, appearance, performance, statements, and biographical information, in whole or in part, in any medium now known or hereafter devised, throughout the universe, in perpetuity, without further notice, review, approval, credit, or compensation of any kind. All footage, recordings, photographs, transcripts, formats, questions, and other materials created at or in connection with the Contest are and remain the sole and exclusive property of Sponsor, including all copyright and other intellectual property rights therein. You acquire no ownership, residual, royalty, or other interest of any kind. You waive any right to inspect or approve any finished product or the use to which it may be applied, and you release and forever discharge Sponsor and its assigns from any and all claims arising from such use, including claims for defamation, libel, slander, false light, invasion of privacy, misappropriation, right of publicity, emotional distress, or any similar claim, whether foreseen or unforeseen. Contestants sign a separate written appearance release at check-in. If you do not wish to be recorded, do not register and do not attend. Attendance constitutes consent.

11. Contest content and intellectual property

The Kulture Test name, logo, format, gameplay structure, question sets, and all associated materials are the exclusive intellectual property of Sponsor. No contestant or attendee may record, stream, reproduce, or distribute the event, or use the format or question sets, for any commercial purpose without Sponsor's prior written consent.

12. Conduct and disqualification

Sponsor and the venue may remove any person, and Sponsor may disqualify any contestant, at any time, at sole discretion, without refund, prize, or recourse, for conduct that is disruptive, threatening, abusive, harassing, discriminatory, impaired, or that interferes with the event, its recording, other contestants, or the venue. Cheating in any form — including consulting a phone or other device, coordinating answers, receiving assistance from the audience, or tampering with the operation of the Contest — results in immediate disqualification and forfeiture of all prizes, including any already awarded, which must be returned on demand. Contestants and attendees must follow all instructions from the host, staff, and venue personnel at all times.

13. Assumption of risk

You acknowledge that attendance at a live event involves inherent risks, including risks of personal injury, illness, property loss or damage, and risks associated with crowds, sound levels, lighting, stairs, and premises where alcohol may be served. You knowingly and voluntarily assume all such risks, whether known or unknown.

14. Release

To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue Sponsor, the host venue, prize providers, and each of their respective parents, affiliates, officers, directors, members, employees, contractors, agents, successors, and assigns (the "Released Parties") from any and all claims, demands, damages, costs, expenses, and liabilities of any kind, whether known or unknown, arising out of or relating to registration, attendance, participation, disqualification, forfeiture, the acceptance, use, or misuse of any prize, or any recording or use of your likeness.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or relating to your breach of these Rules, your conduct at the event, your violation of any law or third-party right, or any content or statement you make that is recorded at the event.

16. Limitation of liability

To the maximum extent permitted by law, in no event will the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Contest, however caused and under any theory of liability, even if advised of the possibility of such damages. The total aggregate liability of the Released Parties for any and all claims arising out of or relating to the Contest will not exceed the greater of (a) one hundred dollars ($100) or (b) the value of the prize actually awarded to the claimant. Nothing in these Rules limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or personal injury where such limitation is prohibited.

17. Binding arbitration

READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to the Contest or these Rules, including their formation, interpretation, breach, or termination, will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Ohio, or by telephone or videoconference at the claimant's election. The arbitrator's award is final and may be entered as a judgment in any court of competent jurisdiction. Exceptions: either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

18. Class action and jury trial waiver

You and Sponsor each waive the right to a trial by jury and the right to participate in any class, collective, consolidated, or representative action. All claims must be brought in an individual capacity only. The arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim must proceed in court and is severed from arbitration.

19. Remedies

Under no circumstances will a contestant be entitled to, and each contestant hereby waives, any right to claim, injunctive or equitable relief, or any right to enjoin, restrain, or otherwise interfere with the production, exploitation, distribution, exhibition, or advertising of any recording, program, or content produced by Sponsor. A contestant's sole remedy is an action at law for damages, subject to Section 16.

20. Cancellation, changes, and force majeure

Sponsor may postpone, relocate, shorten, suspend, modify, or cancel any event, or amend these Rules, at any time and for any reason, including insufficient registrations, venue issues, weather, illness, labor disputes, public health orders, technical failure, or any cause beyond its reasonable control. Notice will be given to registrants at the contact information provided. Registration is free; no refunds are owed and no compensation of any kind is payable. If an event is cancelled after it has begun, Sponsor may award prizes based on the standing at the point of cancellation, or award none, at its sole discretion. Amended Rules take effect when posted at Sponsor's official rules page. Continued participation after posting constitutes acceptance.

21. Data and communications

Information collected at registration is used to administer the event, communicate about it, and for Sponsor's marketing, and may be retained indefinitely. By opting in to text messages you agree to receive event-related and promotional SMS from Sponsor at the number provided. Message and data rates may apply. Message frequency varies. Reply STOP to opt out, HELP for help. Sponsor does not sell registrant data.

22. Publicity

Except where prohibited by law, acceptance of a prize constitutes consent to Sponsor's use of the winner's name, city and state, likeness, photograph, voice, and statements for advertising, promotional, and publicity purposes in any medium, worldwide, in perpetuity, without additional notice, approval, or compensation. Winners agree to cooperate reasonably with Sponsor's publicity efforts as a condition of receiving the prize.

23. Platform disclaimer

The Contest is not sponsored, endorsed, administered by, or associated with Instagram, TikTok, Meta, YouTube, X, or any other social media platform. Participants release each such platform from all liability in connection with the Contest.

24. General

Governing law. These Rules are governed by the laws of the State of Ohio, without regard to conflict of law principles. Subject to Section 17, exclusive venue lies in the state and federal courts located in Summit County, Ohio, and you consent to personal jurisdiction there. Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder of these Rules will remain in full force. No waiver. Sponsor's failure to enforce any provision is not a waiver of that or any other provision. Assignment. Sponsor may assign these Rules and all rights granted under them, in whole or in part, without notice or consent. You may not. Survival. Sections 10, 11, 14, 15, 16, 17, 18, 19, and 24 survive the conclusion of any event. Headings are for convenience only and do not affect interpretation.
